These Terms & Conditions govern your access to and use of TopStore eMarket. By creating an account, listing products, making a purchase, or otherwise using the platform, you agree to be bound by these terms and our related policies.

About TopStore eMarket

TopStore eMarket is a multi-vendor online marketplace that connects customers with independent vendors offering products through one digital platform. TopStore provides marketplace infrastructure, support services, and platform oversight, while vendors remain responsible for the products they list and sell, subject to platform rules and applicable law.

Section 2

Acceptance of Terms

By accessing or using TopStore eMarket, you confirm that you have read, understood, and agreed to these Terms & Conditions and all related policies published on the platform. If you do not agree to these terms, you should not use the platform.

Section 3

User Accounts

Users may be required to create an account to access certain features of the platform. You agree to provide accurate, current, and complete information during registration and to keep your details updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account. TopStore eMarket reserves the right to suspend or terminate accounts that contain false information, are used fraudulently, or are operated in breach of platform policies.

Section 4

Marketplace Role

TopStore eMarket operates as a marketplace connecting customers with independent vendors. While TopStore may monitor listings, support payments, assist with order handling, and help resolve disputes, vendors remain responsible for the legality, quality, pricing, accuracy, and fulfillment of the products they sell.

TopStore eMarket reserves the right to remove listings, suspend vendors, cancel transactions where reasonably necessary, or take other steps to protect customers, vendors, and the integrity of the platform.

Section 5

Orders and Product Availability

All orders placed on the platform are subject to product availability, vendor acceptance where applicable, payment confirmation, and review for fraud or compliance concerns.

TopStore eMarket or the vendor may cancel or decline an order where a product is unavailable, incorrectly priced, restricted, suspected to be fraudulent, or otherwise cannot be fulfilled. Where payment has already been made for a cancelled order, the applicable refund process will be followed.

Section 6

Pricing and Product Information

Vendors are responsible for ensuring that product descriptions, images, specifications, stock levels, and prices are accurate and not misleading.

TopStore eMarket does not permit false, deceptive, or materially inaccurate listings. Where a listing contains a clear error in price, description, stock status, or product details, TopStore eMarket reserves the right to correct the issue, remove the listing, or cancel the affected order.

Section 7

Payments

Payments may be made through the approved payment methods made available on the platform. By making a payment, the customer confirms that they are authorized to use the selected payment method.

TopStore eMarket may hold, review, delay, or reverse transactions where reasonably necessary for fraud prevention, dispute handling, refund processing, compliance review, or operational reconciliation.

Section 8

Delivery

Delivery timelines shown on the platform are estimates only and may vary depending on location, vendor readiness, courier performance, weather conditions, public holidays, or other operational circumstances. TopStore eMarket and its vendors will make reasonable efforts to support timely delivery, but delivery dates are not guaranteed unless expressly stated.

Section 9

Returns and Refunds

Returns and refunds are governed by the TopStore eMarket Refund & Return Policy. Customers are encouraged to review that policy before making a purchase.

Section 10

Prohibited Use

Users may not use the platform to commit fraud, attempt payment abuse, list or purchase illegal or prohibited goods, misrepresent products or account information, interfere with platform systems or security, or engage in abusive, dishonest, or unlawful conduct. TopStore eMarket may suspend or terminate access where prohibited conduct is identified or reasonably suspected.

Section 11

Vendor Responsibilities

Vendors using TopStore eMarket agree to comply with all platform policies and applicable laws. Vendors are responsible for ensuring that their products are lawful, genuine, safe, accurately described, and properly fulfilled.

Vendors must provide valid onboarding information, maintain correct payout details, comply with tax and licensing obligations, and cooperate with customer support, compliance review, and dispute handling where required.

Section 12

Intellectual Property

All TopStore eMarket branding, logos, website content, graphics, and other non-vendor materials are protected and may not be copied, reproduced, or used without permission. Vendors remain responsible for ensuring that the images, brand references, and content they upload do not infringe the rights of others.

Section 13

Suspension and Termination

TopStore eMarket reserves the right to suspend, restrict, or terminate any account, listing, transaction, or platform activity where there is a breach of these Terms & Conditions, fraud risk, policy violation, legal concern, or operational necessity.

Section 14

Limitation of Platform Responsibility

TopStore eMarket takes reasonable steps to support safe and reliable marketplace operations, but does not guarantee uninterrupted platform access, error-free service, or the performance of third-party couriers, payment providers, or vendor actions. Nothing in these Terms & Conditions excludes any rights that cannot lawfully be excluded under applicable law.

Section 15

Changes to Terms

TopStore eMarket may update these Terms & Conditions or related policies from time to time. Updated versions will apply once published on the platform. Users are encouraged to review these pages periodically.

Section 16

Governing Law

These Terms & Conditions shall be governed by the laws of the Republic of Zambia.
